1. Acceptance of Terms

These Terms of Use (“Terms”) govern your access to and use of UtilityEducation.com (the “Site”) and all courses, materials, and services offered by Utility Accounting and Rates Specialists, LLC (“we,” “us,” or “our”). By accessing the Site or enrolling in any course, you agree to be bound by these Terms. If you do not agree, do not use the Site.

2. Course Enrollment and Access

Enrollment

Course enrollment is completed through our Thinkific learning platform. Upon successful payment, you will receive access to the course materials for the period specified at the time of enrollment (currently 12 months from the date of enrollment).

 

Personal Use Only

Course access is granted to the individual purchaser only. Sharing login credentials, distributing course materials, or allowing others to access your account is strictly prohibited and may result in immediate termination of access without refund.

 

Course Content

Course content, including video lessons, slides, exercises, and downloadable materials, is provided for educational purposes only. Content is updated periodically at our discretion. We do not guarantee that all content will remain available for the duration of your access period.

3. CPE Credits and NASBA Compliance

Utility Accounting and Rates Specialists, LLC is registered with the National Association of State Boards of Accountancy (NASBA) as a sponsor of continuing professional education on the National Registry of CPE Sponsors. State boards of accountancy have final authority on the acceptance of individual courses for CPE credit.

To receive CPE credit, you must:

•       Complete all required course lessons

•       Pass the final assessment with a score of 70% or higher

•       Unlimited retakes of assessments are permitted

 

Certificates of Completion documenting your CPE hours will be issued upon successful course completion. It is your responsibility to verify with your state board or professional association that the course qualifies for your specific CPE requirements.

4. Payment and Pricing

Course prices are stated in U.S. dollars and are subject to change without notice. Prices at the time of enrollment are final for that transaction. We reserve the right to offer promotional pricing at our discretion.

Payment is processed through our third-party payment processor. By providing payment information, you represent that you are authorized to use the payment method provided.

5. Refund Policy

Requests for refunds must be made in writing within 30 days of purchasing the course. No refunds will be granted after the qualified assessment has been completed. To request a refund, contact us at russ.hissom@utilityeducation.com or 608-628-4020.

Group training and organizational licensing agreements are subject to separate refund terms as specified in the applicable agreement.

6. Intellectual Property

All content on the Site and within our courses — including but not limited to video lessons, written materials, exercises, slide presentations, and course design — is the proprietary intellectual property of Utility Accounting and Rates Specialists, LLC and is protected by U.S. and international copyright law.

You may not:

•       Copy, reproduce, distribute, or republish any course materials without written permission

•       Record, screenshot, or capture video lesson content

•       Use course materials for commercial purposes or to create competing products

•       Remove or alter any copyright notices or proprietary markings

 

You may download and print materials expressly designated as downloadable for your personal professional use only.

7. Acceptable Use

You agree to use the Site and course materials only for lawful purposes and in accordance with these Terms. You agree not to:

•       Attempt to gain unauthorized access to any part of the Site or another user’s account

•       Interfere with the operation of the Site or its related systems

•       Upload or transmit any harmful, offensive, or illegal content

•       Use automated tools to access or scrape the Site

•       Impersonate any person or entity

8. Disclaimer of Warranties

Course materials are provided for informational and educational purposes only. They do not constitute legal, accounting, tax, or professional advice. You should consult a qualified professional for advice specific to your situation.

THE SITE AND ALL COURSE MATERIALS ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, UTILITY ACCOUNTING AND RATES SPECIALISTS, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR COURSE MATERIALS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claim arising from these Terms or your use of the Site shall not exceed the amount you paid for the course or service giving rise to the claim.

10. Governing Law

These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Wisconsin, and you consent to the personal jurisdiction of those courts.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will post the updated Terms on this page with a revised effective date. Your continued use of the Site after any modifications constitutes your acceptance of the updated Terms.

12. Termination

We reserve the right to suspend or terminate your account and course access at any time, with or without notice, for violation of these Terms or for any other reason at our discretion. Upon termination, your right to access course materials ceases immediately. Refunds upon termination for cause will not be issued.
